DECISÃO:
Trata-se de recurso extraordinário com agravo contra decisão de inadmissão do recurso extraordinário.
O recurso foi interposto com fundamento na alínea "a" do permissivo constitucional.
O acórdão recorrido ficou assim ementado:
"PROCESSO CIVIL: AGRAVO LEGAL. ARTIGO 557 DO CPC. DECISÃO TERMINATIVA. SFH. MÚTUO HABITACIONAL. APÓLICE DE SEGURO. AÇÃO INDENIZATÓRIA. RECURSOS DO FUNDO DE COMPENSAÇÃO DE VARIAÇÕES SALARIAIS - FCVS. CAIXA ECONÔMICA FEDERAL. INTERESSE. INTERVENÇÃO. LIMITES E CONDIÇÕES. RESP 1.091.3 63/SC, STJ, INCIDENTE DE PROCESSO REPETITIVO. RECURSO IMPROVIDO."
No recurso extraordinário sustenta-se violação do(s) art.(s) 62, § 1º, inciso I, alínea b; 62, § 1º, inciso III; 165, § 9º, alínea II; e 192, da Constituição Federal.
Decido.
Analisados os autos, verifica-se que o(s) dispositivo(s) indicado(s) como violado(s) no recurso extraordinário carece(m) do necessário prequestionamento, sendo certo que não foram opostos embargos de declaração para sanar eventual omissão no acórdão recorrido. Incidem na espécie as Súmulas 282 e 356/STF. Nesse sentido:
“Agravo regimental no recurso extraordinário com agravo. Prequestionamento. Ausência. Incidência das Súmulas nºs 282 e 356/STF. Precedentes. 1. É inadmissível o recurso extraordinário se a matéria constitucional que nele se alega violada não está devidamente prequestionada. Incidência das Súmulas nºs 282 e 356/STF. 2. Agravo regimental não provido, com imposição de multa de 1% (um por cento) do valor atualizado da causa (art. 1.021, § 4º, do CPC). 3. Havendo prévia fixação de honorários advocatícios pelas instâncias de origem, seu valor monetário será majorado em 10% (dez por cento) em desfavor da parte recorrente, nos termos do art. 85, § 11, do Código de Processo Civil, observados os limites dos §§ 2º e 3º do referido artigo e a eventual concessão de justiça gratuita” (ARE nº 1.230.706/DF - AgR, Tribunal Pleno, Rel. AUSÊNCIA DE OPOSIÇÃO DE EMBARGOS DE DECLARAÇÃO. PREQUESTIONAMENTO NÃO DEMONSTRADO. INCIDÊNCIA DAS SÚMULAS 282 E 356 DO SUPREMO TRIBUNAL FEDERAL. Ante o exposto, nego seguimento ao recurso (alínea c do inciso V do art. 13 do Regimento Interno do Supremo Tribunal Federal).
Havendo prévia fixação de honorários advocatícios pelas instâncias de origem, seu valor monetário será majorado em 10% (dez por cento) em desfavor da parte recorrente, nos termos do art. 85, § 11, do Código de Processo Civil, observado os limites dos §§ 2º e 3º do referido artigo e a eventual concessão de justiça gratuita.
