DECISÃO:

Trata-se de recurso extraordinário com agravo contra decisão de inadmissão do recurso extraordinário.

O recurso foi interposto com fundamento na alínea "a" do permissivo constitucional.

O acórdão recorrido ficou assim ementado:

PRELIMINAR DE NULIDADE - Depoimento especial da vítima. Alegação de dificuldade de compreensão dos depoimentos, que ocasionaria cerceamento de defesa. Inocorrência. Áudios encartados aos autos que se encontram adequados à compreensão. Preliminar rejeitada.

ESTUPRO DE VULNERÁVEL - Autoria e materialidade comprovadas. Pena. Adequada. Continuidade delitiva configurada. Indenização a título de reparação por danos morais. Requerimento do Ministério Público. Montante adequado e proporcional. Recurso desprovido.

No recurso extraordinário sustenta-se violação do(s) art.(s) 5º, incisos LIV, LV e LVII, e 93, inciso IX, da Constituição Federal.

Analisados os autos, verifica-se que o(s) dispositivo(s) indicado(s) como violado(s) no recurso extraordinário carece(m) do necessário prequestionamento, sendo certo que não foram opostos embargos de declaração para sanar eventual omissão no acórdão recorrido. Incidem na espécie as Súmulas 282 e 356/STF. Nesse sentido:

“Agravo regimental no recurso extraordinário com agravo. Prequestionamento. Ausência. Incidência das Súmulas nºs 282 e 356/STF. Precedentes. 1. É inadmissível o recurso extraordinário se a matéria constitucional que nele se alega violada não está devidamente prequestionada. Incidência das Súmulas nºs 282 e 356/STF. 2. Agravo regimental não provido, com imposição de multa de 1% (um por cento) do valor atualizado da causa (art. 1.021, § 4º, do CPC). 3.
